1. Acceptance of Terms

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

You must be at least 18 years old to use our Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

2. Description of Service

People You Know is a platform that connects employers with job seekers. Our Service includes:

• Job posting and search functionality
• Candidate profile creation and management
• Matching algorithms to connect employers with suitable candidates
• Communication tools for employers and job seekers
• Payment processing for premium services
• Mobile applications for iOS and Android devices

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. User Accounts

3.1 Account Registration

To use certain features of our Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3.2 Account Types

We offer different account types:

• Job Seeker Accounts: Free accounts for individuals seeking employment opportunities
• Employer Accounts: Accounts for businesses and organizations posting job opportunities (may include paid features)

3.3 Account Termination

You may terminate your account at any time by contacting us or using the account deletion feature. We reserve the right to suspend or terminate your account if you violate these Terms or engage in any fraudulent, abusive, or illegal activity.

4. User Conduct and Responsibilities

You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Post false, misleading, or fraudulent information
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Harass, abuse, or harm other users
• Post discriminatory, offensive, or inappropriate content
• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of others
• Upload viruses, malware, or other harmful code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated systems (bots, scrapers) to access the Service without permission
• Interfere with or disrupt the Service or servers
• Collect or harvest information about other users without their consent
• Use the Service for any commercial purpose not expressly permitted by us

5. Content and Intellectual Property

5.1 User Content

You retain ownership of any content you post, upload, or submit to our Service ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, and transferable license to use, reproduce, distribute, modify, adapt, and display your User Content in connection with operating and providing the Service.

You represent and warrant that:

• You own or have the necessary rights to post the User Content
• Your User Content does not violate any third-party rights
• Your User Content is accurate and not misleading

5.2 Our Intellectual Property

The Service, including its design, features, functionality, and content (excluding User Content), is owned by People You Know and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

5.3 Trademarks

"People You Know" and our logos are trademarks of People You Know. You may not use our trademarks without our prior written permission.

6. Job Postings and Applications

6.1 Employer Responsibilities

Employers posting jobs on our platform agree to:

• Post only legitimate job opportunities
• Provide accurate job descriptions and requirements
• Respond to applications in a timely and professional manner
• Comply with all applicable employment laws and regulations
• Not discriminate against applicants based on protected characteristics
• Honor commitments made to job seekers

6.2 Job Seeker Responsibilities

Job seekers agree to:

• Provide accurate and truthful information in profiles and applications
• Only apply for positions for which they are qualified
• Respond to employer communications professionally and promptly
• Not misrepresent qualifications, experience, or credentials

6.3 No Guarantee of Employment

We do not guarantee that job seekers will find employment or that employers will find suitable candidates. We are a platform that facilitates connections but are not a party to any employment relationship.

7. Payments and Billing

7.1 Premium Services

Certain features of our Service may require payment ("Premium Services"). By purchasing Premium Services, you agree to pay all fees associated with your selected plan.

7.2 Billing

Fees are billed in advance on a recurring basis (monthly or annually) unless otherwise stated. You authorize us to charge your payment method for all fees incurred.

7.3 Refunds

Refund policies vary by service. Generally, we do not provide refunds for Premium Services unless required by law or as otherwise specified. If you cancel your subscription, you will continue to have access until the end of your billing period.

7.4 Price Changes

We reserve the right to modify pricing at any time. Price changes will be communicated to you in advance, and you may cancel your subscription if you do not agree to the new pricing.

8. Privacy

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Defects will be corrected
• The Service is free of viruses or other harmful components
• The results obtained from using the Service will be accurate or reliable

We are not responsible for the accuracy, completeness, or reliability of any User Content or information posted by users. We do not verify the credentials, qualifications, or background of users.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEOPLE YOU KNOW AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Unauthorized access to or alteration of your data
• Statements or conduct of any third party on the Service
• Any other matter relating to the Service

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless People You Know and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any User Content you post or submit

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your account settings.

12.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice, if you:

• Violate these Terms
• Engage in fraudulent, abusive, or illegal activity
• Fail to pay fees when due
• Otherwise engage in conduct that we determine is harmful to other users or our business

12.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and User Content. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Philippines, without regard to its conflict of law provisions.

13.2 Dispute Resolution Process

In the event of any dispute arising from or relating to these Terms or the Service, the parties agree to first attempt to resolve the dispute through good faith negotiations. If the dispute cannot be resolved through negotiations, the parties agree to submit the dispute to binding arbitration in accordance with the rules of the Philippine Dispute Resolution Center, or as otherwise agreed by the parties.

13.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Sending you an email notification (for significant changes)
• Displaying a prominent notice on our Service

Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and People You Know regarding your use of the Service and supersede all prior agreements and understandings.

17. Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

18. Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms or our rights and obligations hereunder without restriction.
